| The Social Protection System in Health, also known as Popular Insurance, represents a great advance in the structural reform to ensure the effective protection of rights to health. It broadens the coverage of health care services, provides medicines and hospital attention to those who have no other social insurance mechanisms and have decided to join it voluntarily. The System also specifies the rights, goods and services granted to eligible members. However, the complexity of its implementation, the diversity of actors involved in shaping the provision of services referred to the system itself, and the lack of a clear regulatory frame regarding the competences of different levels of government, lead to serious inaccuracies on the means of legal protection to safeguard the effectiveness of rights guaranteed by the System. Precisely, this article aims at describing the shortcomings of legal protection to the beneficiaries of the system through the legal analysis and systematization of the Popular Insurance. El Sistema de Protección Social en Salud, también conocido bajo el nombre de Seguro Popular, supone un gran avance dentro de la reforma estructural para garantizar la efectividad del derecho de protección social en salud, pues amplía la cobertura de los servicios de atención médica, hospitalarios y de medicamentos sin cuotas de recuperación a todos aquellos que carezcan de mecanismos de aseguramiento social y que decidan afiliarse de manera voluntaria al sistema. Además, por supuesto, de especificar previamente cuáles son los derechos, bienes y servicios que contempla el propio sistema. Sin embargo, la complejidad de su instrumentación, la diversidad de actores que participan en la conformación de la prestación de los servicios antes indicados, así como la falta de claridad normativa respecto de las atribuciones y competencias en los diferentes niveles de gobierno, propician serias imprecisiones sobre las vías de tutela jurisdiccional adecuadas para salvaguardar la efectividad de los derechos consagrados por el sistema. Este artículo pretende, precisamente, poner de manifiesto tales carencias, a través de la sistematización de la conformación normativa del Seguro Popular. | |
